1. Operator and Scope
The Website is operated by EULBURG Additive Manufacturing. In these Terms, “EULBURG,” “we,” “us,” and “our” mean that operator. “Website” means the public website pages, forms, files, media, and other resources under the Website domain that display, link to, or are presented with these Terms. “Order” means a binding purchase or sale transaction separately formed under the applicable transaction documents. “DPP” means a Digital Part Passport feature that EULBURG expressly identifies as such. A separately identified customer portal, DPP feature, transaction document, or third-party service may be subject to an additional notice or scope that EULBURG expressly provides for it.
The Website is intended for business-information and business-inquiry use. These Terms state the conditions on which EULBURG permits use of the Website. They do not by themselves form a sale, purchase, confidentiality, engineering, manufacturing, consulting, support, hosting, or other transaction.
2. Permitted Use
You may view and use the Website for lawful business-information and inquiry purposes. You must not:
(a) interfere with, disrupt, damage, or materially overload the Website; conduct security testing or probe an account, system, or data without authorization; or attempt unauthorized access;
(b) introduce malicious code or use the Website for fraud, impersonation, unlawful conduct, or infringement;
(c) bypass an access, security, rate-limit, or authorization control;
(d) use automated means to evade a control, collect personal or protected information without authorization, or materially burden or disrupt the Website; this does not prohibit lawful, nondisruptive accessibility testing, internal procurement review, or ordinary use by a generally available search engine that respects EULBURG's published crawler instructions; or
(e) use Website content, marks, or data to misrepresent an affiliation, authorization, certification, product source, technical result, or EULBURG commitment.
EULBURG may limit or block access reasonably believed to violate these Terms or threaten the Website, users, systems, or rights of others, subject to applicable law. This Section does not restrict a use that applicable law does not permit EULBURG to prohibit.
3. Informational Content; No Offer or Approval
Website content is general information. It is not a binding quotation, offer, Order, purchase order, acceptance, warranty, engineering approval, professional opinion, product or application certification, export classification, regulatory determination, or final suitability decision. A request submitted through the Website is an inquiry only. Submission or receipt does not require EULBURG to evaluate, respond, quote, accept work, reserve capacity, supply a product, meet a schedule, or form an Order.
An actual transaction is governed only by the transaction documents validly adopted for that transaction, which may include an applicable quotation, acceptance record, purchase order, standard terms expressly incorporated into the transaction, or signed agreement. Website content does not alter those documents.
4. Technical, Material, and Application Information
Technical values, material descriptions, images, examples, demonstrations, and application references apply only to the identified source, product form, grade, specimen, method, condition, revision, and scope stated with them. Manufacturer information remains information of its identified source unless EULBURG expressly adopts a commitment in a transaction document. General Website content does not establish a guaranteed value, lot result, final-part property, production qualification, regulatory status, end-use approval, availability, continuity, or customer-specific result.
General Website content is not a substitute for your independent technical and regulatory evaluation. Responsibility for a transaction is governed by its valid transaction documents and applicable law, including any defined responsibility EULBURG expressly accepts and any duty that cannot lawfully be allocated. Confirm the current source and any transaction-specific requirements before relying on technical information.
5. Public Inquiries and Data-Submission Boundary
Use the public inquiry form only for routine business contact information, product interest, quantity and timing information, and a general nonconfidential project description. Do not submit confidential technical files or detailed nonpublic technical information through an ordinary public field or email unless EULBURG first confirms an approved channel and the parties have completed any required signed nondisclosure agreement.
Do not submit classified information, ITAR-controlled technical data, controlled unclassified information, or other specially restricted information through the Website or an ordinary inquiry channel. EULBURG may decline any request to handle such information. No exception is authorized unless EULBURG first provides written, project-specific confirmation that identifies the exact information category, approved scope and channel, and controls implemented and validated before access or receipt. A form, checkbox, email, nondisclosure agreement, encryption method, or urgent request does not by itself establish approval, acceptance, or capability.
The EULBURG Privacy Notice describes personal-information practices for its stated scope. A separate Pre-Quotation Notice may provide additional intake instructions. Neither notice creates an Order or retroactively applies later sales terms.
6. Digital Part Passport and Other Restricted Interfaces
This Section describes DPP links and features presented on the Website. It does not by itself extend these Terms to a separately operated DPP interface unless that interface displays or expressly links to these Terms.
A public DPP gateway, sample record, reference identifier, marker, or demonstration does not grant access to protected content or establish that DPP is included in a transaction. DPP access and functionality exist only when EULBURG expressly provides them for an identified transaction, authorized user or user class, approved domain, approved downstream role, or record expressly approved for public access under the applicable DPP scope. That scope, not this public Website, controls the covered items, fields, sources, users, access mode, documents, corrections, retention, support, availability, deliverables, permitted use and reliance, copying or export, onward disclosure, confidentiality, and indexing.
If a DPP record is approved for public access, only the fields expressly released for that record are public. Other DPP content remains governed by the applicable DPP scope.
A DPP record or status does not by itself certify a product, final part, assembly, customer application, regulatory result, inspection acceptance, or immutable history. Do not attempt to access, use, share, or test a DPP identifier or account without authorization.
7. Other Documents
An applicable quotation, acceptance record, purchase order, signed nondisclosure agreement, statement of work, DPP scope, data/security scope, signed agreement, or standard terms expressly incorporated and validly adopted for a transaction controls its assigned subject. These Terms do not incorporate another transaction document into ordinary browsing and do not supersede an applicable signed agreement.
8. Intellectual Property and Marks
The Website and its EULBURG-created text, design, graphics, interfaces, and other content are owned by or licensed to EULBURG and are protected by applicable intellectual-property laws. EULBURG, LEHVOSS, LUVOCOM, product names, logos, and other marks belong to their respective owners. You may view the Website for the permitted purpose in Section 2. For public content that EULBURG expressly makes downloadable, you may, only to the extent EULBURG is authorized to grant this permission, reasonably download, print, and circulate that content within your organization solely for evaluation and procurement, with notices retained and subject to all stated source-specific and third-party restrictions. This permission grants no right broader than EULBURG owns or is authorized to pass through. No other Website use grants a license to a mark, source code, technical data, profile, dataset, design, image, or other content.
You may link to a public Website page through an ordinary text link that does not frame the page, bypass a control, or imply affiliation, approval, or endorsement. Do not remove notices or reproduce, modify, publish, distribute, sell, sublicense, create derivative works from, or commercially exploit protected Website content without the applicable owner's prior written permission, except to the extent applicable law or an express authorization permits the use. Rights not expressly granted are reserved.
9. Third-Party Links and Information
The Website may link to separate sites, customer interfaces, manufacturer resources, or other third-party resources. Providing a link does not by itself mean that EULBURG operates the destination or endorses its statements, products, services, security or privacy practices, or availability. A separate destination may be subject to its own terms, notices, and current source materials. EULBURG is not responsible for another operator's site or conduct except to the extent responsibility cannot lawfully be excluded or EULBURG expressly accepts it in a signed agreement.
10. Availability, Errors, and Changes
EULBURG may correct, update, suspend, restrict, or discontinue public Website content or functionality. Content may contain errors or become outdated. EULBURG does not promise uninterrupted availability, a response time, permanent access, or that every displayed product, service, record, or feature is currently offered. This Section does not alter an express access, availability, support, retention, or discontinuation commitment that EULBURG validly accepts in a transaction document for its identified subject.
11. Website Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EULBURG MAKES NO WARRANTY, EXPRESS OR IMPLIED, ABOUT THE WEBSITE OR GENERAL WEBSITE CONTENT AND DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EULBURG DOES NOT WARRANT UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR THE SUITABILITY OF GENERAL WEBSITE CONTENT FOR A PARTICULAR APPLICATION. THIS DISCLAIMER DOES NOT LIMIT AN EXPRESS COMMITMENT EULBURG VALIDLY ACCEPTS IN A TRANSACTION DOCUMENT OR A DUTY OR REMEDY THAT APPLICABLE LAW DOES NOT PERMIT EULBURG TO EXCLUDE.
12. Website-Use Liability
To the maximum extent permitted by applicable law, EULBURG is not liable for indirect, incidental, special, exemplary, or consequential loss arising from use of or inability to use the public Website, or from reliance on general Website content instead of an applicable transaction document or current identified technical source. This limitation does not apply to liability that applicable law does not permit EULBURG to limit, and it does not change the liability allocation in a valid transaction document.
13. Good-Faith Resolution; Governing Law and Forum
EULBURG encourages informal business discussion before litigation when practical. This does not prevent a party from seeking urgent relief, preserving evidence, meeting a filing deadline, or reporting a matter to an authority.
These Terms are governed by Texas law, without applying its conflict-of-laws rules to select another jurisdiction's law. Subject to applicable jurisdiction and nonwaivable law, an action concerning these Terms must be brought in a state court located in, or a federal court serving, Dallas County, Texas.
14. Changes and Document Boundary
Each released version of these Terms applies prospectively from its stated effective date. EULBURG may change the Terms prospectively by posting a new controlled version. A change does not retroactively alter an earlier transaction, signed agreement, protected submission, or event.
Access to a footer link or continued browsing alone does not form a sales contract, purchase contract, nondisclosure agreement, DPP scope, or agreement to transfer restricted data.
